PLANNING COMMISSION MEETING
415 N. MILWAUKEE ST.
MAY 4, 2009 at 6:00 PM
UNAPPROVED/UNOFFICIAL MINUTES

1. Planning Commission meeting was called to order at 6:00 PM by Chairman Langmesser. Present: Langmesser, Schmidt, Ranke, Draskovich, Gerard, Derse, Szeklinski, Attorney Dubis and Residents.

2. Chairman Langmesser led the Pledge of Allegiance.

3. Ranke motioned to approve the April 6, 2009 meeting minutes as written, seconded by Szeklinski. Motion carried.

4. Correspondence- None

5. Pier Permit - Hartung/Hincz, LLC, 7212 N. Tichigan Rd. - Draskovich was concerned about the existing concrete steps that are disrepair. Gerard stated that once the concrete stairs are removed that you can not replace with concrete but he could replace with wooden steps or cover the concrete steps with wooden steps. Gerard motioned to approve, seconded by Draskovich. All in favor. Motion carried.

6. Pier Permit- Gonder, 5402 W. Peninsula Rd. - Draskovich indicated that there was between 150' to 160' of frontage. Draskovich motioned to approve the pier, seconded by Szeklinski. Derse indicated that he would abstain from voting as he is the neighbor to Mr. Gonder. Motion carried.

7. Shore land Contract Report- Gerard reported one shoreland contract.

8. Announcements/Discussion- Chairman Langmesser noted that the police were busy citing residents whose yards needed to be cleaned up. Supervisor Mary Kacmarcik indicated that the Waterford Woods Homeowners Assoc. is concerned about cleaning up the area in Waterford Woods. She also indicated that there was one particular residence that needed special attention as the yard is so cluttered. Langmesser noted that he was aware of this property. The police dept. will be informed of this residence.

Gerard motioned to adjourn the meeting at 6:11 PM, seconded by Schmidt. Motion carried.

TOWN BOARD MEETING FOR WATERFORD
UNAPPROVED/UNOFFICIAL MINUTES FOR MAY 11, 2009
6:00 PM AT TOWN HALL

1. Town Board meeting was called to order at 6:00 PM by Chairman Langmesser. Present: Gauerke, Block, Baumgart, Kacmarcik, Attorney Dubis and residents of the Town.

2. Chairman Langmesser led the Pledge of Allegiance.

3. Printed Minutes: Block motioned to approve the Town Board meeting minutes dated April 13, 2009 as corrected, seconded by Gauerke. Motion carried. Baumgart motioned to approve the special meeting minutes dated April 13th and April 17th, 2009 minutes as printed, seconded by Gauerke. Motion carried.

4. Treasurer Report/Payment of Claims- Kacmarcik motioned to approve the claims as presented, seconded by Block. Motion carried. Langmesser read the treasurers report.

5. Correspondence: None

6. Committee Reports:
(a) Police Dept. Report- Chief Ditscheit reported that he attended Teen Night at Washington School a week ago Friday. About 165 children from Washington School and surrounding schools such as Drought, North Cape and the Villages of Waterford and Rochester. The children were very good and enjoyed the event. It is a worthwhile event that will be held quarterly, rotating at other schools. Many properties have come into compliance in the CUT program. Others have been cited. The Department has received many compliments about the program. I attended a new School Safety Meeting at Washington School today (Monday). This identified several issues and in the future meetings will be held regularly. With the installation of new carpeting, remodeling in the Department has been completed. Help to clear the Department during carpeting came from DPW, the Clerks Office and the Village DPW. Thanks to everyone for their help. The pontoon boat was loaned to the Village DPW for installing buoys.
(b) Waterways Committee- Bob Hardy stepped in for Dick Kosut. Making progress eliminating weeds. Preliminary report looks great.
(c) Park- None
(d) Road Dept. - Langmesser noted that the Town has already chosen which roads will be fixed this year. Should start within the next months. Request for purchase of a mower to be paid with park impact money. Langmesser received two quotes: CPI and Proven Power. Gauerke motioned to approve park funds for the purchase of the Ferris mower from Cooperative Plus Inc., seconded by Block. Kacmarcik questioned why the Ferris at $11,388.00 vs. the John Deere at $10,248.38. Langmesser indicated that it was a better mower for what it is being used for. Motion carried.
(e) Tichigan Vol. Fire Co. - Todd Bluhm gave report. Open house this weekend from 11-3 pm. Bluhm indicated that they completed the fire dues certification and gave the town a copy on this night. Kacmarcik noted that she obtained a quote for the insulation at fire station #2. Langmesser had appointed Kacmarcik to meet with Bluhm and Ken Hinz regarding this matter. The quote was for $10,000. Board will have to decide if this is something that they want to do in order to save money on heating costs. Kacmarcik questioned how much it costs to heat for one year. Langmesser indicated that they insulated the roof, put on new doors, put in new thermostats and new furnaces and it won't do any good because it is the block that is letting all the cold air in/heat out and needs to be insulated. Langmesser indicated that Ken Hinz is applying for a grant for the park at fire station #2. Kacmarcik to work with Ken to see if this could be part of the grant. Langmesser further noted that something has to be done with this station or it will be shut down as no one is in the building.
(f) Town Planning Recommendations-

" Pier Permit- Gonder, 5403 W. Peninsula Rd.- Gauerke motioned to accept approval, seconded by Block. Motion carried.

7. Old Business:
(a) Information- Walk path in Waterford Woods- Kacmarcik noted that she presented this matter before the board about a year ago. Kacmarcik indicated that there was money set aside for this but was later put into the same fund as road repair and road repair got it because they did not need it at this time. There have been more requests for a walk way up towards Waterford Woods. Kacmarcik will be trying to secure some grants but may have to come back to the board for assistance. The Village of Waterford will also have to be involved as the residents on that side have a Village easement even though the Town maintains Rivermoor and Waterford Dr. This walk way may alleviate the need for buses as some children who take the bus do so for safety reasons.

8. New Business:
(a) Request for temporary speed bumps- Golden Meadows #3- Dave Michaelson, 8225 Marjorie Dr., indicated that there is a lot of problems with drivers speeding around the curve. He believes the curve is dangerous. He also indicated to the board that there is an exit at the curve for the bike bath. Michaelson indicated that he has purchased the speed bumps and would store them on his property. Langmesser suggested that wooden posts be installed to keep people from cutting the corner short and force them to stay on the asphalt. Chief Ditscheit reported that the Department has issued numerous citations for speeding. He also agreed that putting posts along the roadway on the curve would likely slow traffic on the curve. The speed bumps were not approved based on the recommendation of Chief Ditscheit. Langmesser instructed Perry Baumann, DPW, to install two posts and to use the 3' stenciling sign, 25 mph.
(b) Letter of Credit Reduction request- Foxwater Bay- Langmesser noted that Attorney Michael Dubis was instrumental in getting our money for Foxwater Bay. The town can go forward with completing Foxwater Bay subdivision. Dubis noted that the demand that we made on the letter of credit (in the amount of $657,380.35) included Yaggy and Colby and did not include Payne and Dolan or Super Mix but we preserved our right to go after that money. Dubis also indicated that Yaggy Colby has settled and agreed to take approximately $31,000. Dubis recommended that the board reduce the letter in the amount of $657,380.35. Langmesser thanked Attorney Dubis for his work. Gauerke motioned to reduce letter of credit by $657,380.35, seconded by Baumgart. Motion carried.
(c) Appointments- Langmesser motioned to appoint the following, seconded by Kacmarcik. Motion carried.
" Engineer- Kapur and Associates
" Planning Commission #1- Roy Schmidt
" Planning Commission #6- Ted Derse
" Inspector- L & M Inspections
" Attorney- Michael Dubis with outside council to be determined by Attorney Dubis
" Surveyor- Gary Foat
" Health Officer- Racine Co. Health Dept.
" Weed Commission- Carl Kasprzyk

Adjourn Board of Review to a later date- Matter was not addressed at 5:55 pm. Gauerke motioned to adjourn Board of Review to June 19, 2009, seconded by Kacmarcik. Motion carried.

Baumgart motioned to adjourn the meeting at 6:45 PM, seconded by Gauerke. Motion carried.
