TOWN BOARD MEETING FOR WATERFORDUNAPPROVED/UNOFFICIAL MINUTES FOR OCTOBER 13, 20086:00 PM AT TOWN HALL1. Town Board meeting was called to order at 6:00 PM by Chairman Langmesser. Present: Gauerke, Baumgart, Block, Kacmarcik, Attorney Dubis and residents of the Town.
2. Chairman Langmesser led the Pledge of Allegiance.
3. Printed Minutes: Kacmarcik motioned to approve the Town Board meeting minutes dated September 8, 2008 and the special meeting minutes dated September 2, 2008 and September 8, 2008 as printed, seconded by Block. Motion carried.
4. Treasurer Report/Payment of Claims- Langmesser read the Treasurers report. Block motioned to approve the claims as presented, seconded by Kacmarcik. Motion carried.
5. Correspondence: Chairman Langmesser gave a status on Foxwater Bay and what work is currently being completed. Dubis indicated that this is the first time the Town had to draw on a letter of credit.
6. Committee Reports:(a) Police Dept. Report- Chief Ditscheit reported that Officer Hecht saved another life, this time of a man having a heart attack. Former Chief, Ray Littmann saved a man lost in the conservation hunting grounds. Littmann borrowed a neighbors ATV and went looking for the lost man.(b) Waterways Committee- None(c) Park- None(d) Road Dept. - Langmesser reported that there is crack filling yet to be done and culverts to be installed.(e) Town Planning Recommendations-§ Pier Permit- Hendrickson, 4420 N. River Bay Rd. Gauerke motioned to accept Plannings recommendation for approval contingent upon the applicant paying a double permit fee, seconded by Block. Motion carried.(f) Tichigan Volunteer Fire Company- David Wagner reported 5 fire calls and 15 rescue calls since the last time they reported before the board.
7. Old Business: None
8. New Business:(a) Discussion and possible action regarding heating bids at Fire Station #2- Langmesser noted that this building was built 30 years ago and a block building. Langmesser was told that radiant heat was best for this building. NORMCO offered this type of heating. Block motioned to approve the bid from NORMCO not to exceed $4710.00, including three locking thermostats and subject to verification of funds, seconded by Gauerke. Motion carried.(b) Intergovernmental Agreement for Police Services between the Town and Village of Waterford removed from agenda. No longer needed as officer from Village is not leaving the department.(c) Resolution expressing the opposition of the Town of Waterford with a policy of the Department of Natural Resources pertaining to rifles- Dubis noted that this was a policy statement only with no enforcement. Larry Gabrysiak, 32747 Sunburst Ct. noted that allowing the use of rifles for deer hunting season frightens him and his family. Langmesser reported that he was approached by hunters who felt that rifles were unnecessary. Gauerke reminded the board that 10-15 years ago a man was shot in Fairview Estates from a man using a rifle to hunt coyotes. The man was approximately 1 mile away. Block suggested an ordinance. Kacmarcik motioned to approve the resolution with the Clerk mailing a copy to our Representative, Senator, Governor Doyle, head of DNR and municipalities in Racine County, seconded by Gauerke. Motion carried.(d) Discussion and possible action regarding exempting sheds less than 120 sq. ft. from the Uniform Dwelling and Uniform Building Code Dubis drafted an ordinance exempting these sheds from the UDC and UBC but it also lifted and restrictions the town may have over the type of shed being installed. Concerns were raised about no parameters being set for these sheds. Langmesser noted that a resident wanted to build a shed he bought from Menards and the building inspector informed him that he needed a 30lb. snow load. Langmesser would like only this restriction lifted. The board was unclear as to whether this would be allowed as we can not be less stringent than the state. Kacmarcik motioned to postpone until the November Town Board meeting, seconded by Gauerke. Vote taken: 3 in favor, 2 opposed (Langmesser and Baumgart). Motion carried.(e) Discussion regarding portable storage units - The Clerk received a call regarding portable storage units and the Town currently does not have an ordinance relating to these units. Jon Lohr, 7135 Joy Marie Ln. indicated that his neighbor has had his POD on his property for almost a year. Dubis to draft ordinances.(f) Discussion regarding ordinance pertaining to tree removal Dubis reported that the Clerk has received a call from Kreger Lumber regarding cutting trees in the former conservancy that L & T had owned. There was to be no tree cutting when it was the conservancy, now it was bought back by the original owner (Mainus). The Town was informed by SWRPC that they will not enforce tree cutting in PEC but rather it has to be at Town level. Gauerke indicated that he would like to see a permit have to be pulled which would show boundary lines and what needs to be cut. Dubis to draft an ordinance with Gauerkes assistance.
