PLANNING COMMISSION MEETING

JUNE 2, 2008 at 6:00 PM
UNAPPROVED/UNOFFICIAL MINUTES

1. Planning Commission meeting was called to order at 6:00 PM by Chairman Langmesser. Present: Langmesser, Schmidt, Ranke, Draskovich, Gerard, Derse, Szeklinski, Attorney Dubis and Residents.

2. Chairman Langmesser led the Pledge of Allegiance.

3. Commissioner Schmidt motioned to approve the May 5, 2008 meeting minutes as written, seconded by Commissioner Ranke. Motion carried.

4. Correspondence- None

5. Pier Permit- Beck, 5705 E. Peninsula Rd. - Gerard motioned to approve, seconded by Derse. Motion carried.

6. Pier Permit- Graul, 29308 Forest Isle Ln.- Gerard motioned to approve, seconded by Derse. Motion carried.

7. Variance- Otto, 29024 Elm Island Dr.-Commission stressed to Mr. Otto that the Town has an aesthetic ordinance and junk on the property will not tolerated. This matter was brought up due to the fact that Mr. Otto does not plan on having a garage. Gerard motioned to approve the variance, seconded by Draskovich. Motion carried.

8. Rezone Application- Bielinski Homes, HWY 83-Dan Szczap, Bielinski representative, stated that they are looking to rezone to R-2 and that this is consist with the Land Use Plan. Langmesser noted that the new 2035 map shows part of this land as commercial. Mr. Szczap requested if he could amend the application to not include this piece in question. The commission was not comfortable with this and therefore did not allow Mr. Szczap's request. Michael and Brenda Grahm, 4701 Mamerow Ln. and Daniel D'Addio, 4702 Mamerow Ln. expressed their opposition to this development and rezone. Mr. Szczap voluntarily agreed to postpone this request to the July planning commission meeting.

9. CSM- DePree, Hill Valley Rd.-John Hotvedt, attorney for applicant, noted that they would like to keep the A-1 zoning. Dubis stated that the Town is currently in litigation over the same type matter. Dubis stated that this type of separation is reserved for farm family members and that the person intended for this lot is not a family member. Tina Mayer, Town Clerk, informed the commission that Racine Co. has Corps. Counsel reviewing this issue. Attorney Hotvedt voluntarily agreed to postpone this request to the July planning commission meeting.

10. Shore land Contract Report- None

TOWN BOARD MEETING FOR WATERFORD
UNAPPROVED/UNOFFICIAL MINUTES FOR JUNE 9, 2008
6:00 PM AT TOWN HALL

1. Town Board meeting was called to order at 6:00 PM by Chairman Langmesser. Present: Gauerke, Block, Baumgart, Kacmarcik, Attorney Dubis and residents of the Town.
2. Chairman Langmesser led the Pledge of Allegiance.
3. Printed Minutes: Baumgart motioned to approve the Town Board meeting minutes dated Nay 12, 2008 and the special meeting minutes dated May 12, 2008 as written, seconded by Block. Motion carried.
4. Treasurer Report/Payment of Claims- Kacmarcik motioned to approve the claims as presented, seconded by Block. Motion carried. Langmesser read the Treasurer's report.

6. Committee Reports:
(a) Police Dept. Report- Supervisor Kacmarcik indicated that Chief Ditscheit had to attend a CUP hearing at the Village and could not attend.
(b) Waterways Committee- None
(c) Park- None
(d) Road Dept.-Langmesser reported that the roads were being swept as fast as possible after the flooding. Road side cutting to commence this week, weather permitting.
(e) Town Planning Recommendations-
§ Pier Permit- Beck, 5705 E. Peninsula Rd.- Gauerke motioned to accept Planning's recommendation for approval, seconded by Block. Motion carried.
§ Pier Permit- Garul, 29308 Forest Isle Ln.-Gauerke motioned to accept Planning's recommendation for approval, seconded by Baumgart. Motion carried.
§ Variance- Otto, 29024 Elm Island Dr.-Gauerke indicated that he drove past the property and is concerned over storage problems with no garage. Gauerke indicated that the foundation from the boat house needs to be removed and Mr. Otto needs to repair the shoreline. Josh Otto indicated that he would. Gauerke motioned to approve the variance subject to removal of the foundation of the boathouse and restoring the shoreline both to be completed within 30 days, seconded by Block. Motion carried.
§ Rezone Application-Bielinski Homes- No action as applicant postponed until July planning.
§ CSM- DePree, Hill Valley Rd.-No action as applicant postponed until July planning.
7. Old Business:
(a) Class A and Class B Liquor Licenses-Kacmarcik motioned to approve the licenses as presented with the exception of Charlie's as they failed to re-apply, seconded by Gauerke. Motion carried.
(b) Allowing Bona-Fide Clubs the ability to obtain Temp. Class B Licenses that are in no way associated with the Town of Waterford-Dubis noted that if the applicant had a problematic background the Town Board could deny a license. Langmesser motioned to approve, seconded by Gauerke. Motion carried.
(c) Tichigan Volunteer Fire Company-Request for truck referendum-Langmesser reminded those in attendance that the Town is capped at 2.9%. Garrett Forkner indicated that the truck would not exceed $450,000. Forkner noted that they would like to be on a five year truck purchase rotation. Baumgart noted that with the recent re-valuation that the town went through that this was maybe not the best time as people are already worried about their taxes going up. Kacmarcik noted that the town receives mutual aid from surrounding areas and holds a MABAS card.. Kacmarcik motioned to deny the request at this time, seconded by Baumgart. Motion carried.
(d) Wisconsin Uniform Building Code-Schedule of Permit Fees- Clerk indicated that at last month's meeting the board raised the fees but in some cases the raise included making change. The clerk noted that this would be difficult for those paying for permits by cash. Block motioned that anything 50 cents and up to be rounded up to the nearest dollar and anything 49 cents or lower rounded down to the nearest dollar, seconded by Gauerke. Motion carried.

8. New Business:
(a) Original Liquor License-What About Linda's (FKA Lou's Lakeside Pub)-Louis Soeder will surrender the licenses for the former bar. Kacmarcik motioned to approve the request subject to the surrender of the licenses from Lou's Lakeside Pub, seconded by Gauerke. Motion carried.
Fireworks Permit Application-American Pride- Kacmarcik motioned to approve but all future applications should be presented to the Town of Waterford Police Chief, seconded by Block. Motion carried.

Forthcoming events- Langmesser to research concerns of Al Sweet.

Gauerke motioned to adjourn the meeting at 7:10 PM, seconded by Baumgart. Motion carried.

TOWN BOARD MEETING NOTICE

There will be a Special Meeting of the Waterford Town Board on June 28, 2008, at the Town Hall, 415 N. Milwaukee St., Waterford, Wisconsin, at 8:30 AM, for the following purpose:

Ø Discussion and possible action regarding drainage concern located on Riverside Rd. in Waterford Woods
Ø The Board will then adjourn the meeting.

SPECIAL TOWN BOARD MEETING FOR WATERFORD
APPROVED/OFFICIAL MINUTES FOR JUNE 28, 2008 AT 8:30 AM AT TOWN HALL

Special Town Board meeting was called to order at 8:30 AM by Chairman Langmesser. Present: Block, Baumgart, Gauerke, residents and Pat Bogumil, reporter. Supervisor Kacmarcik was excused.

Purpose: Discussion and possible action regarding drainage concern located on Riverside Rd. in Waterford Woods

Alan Sweet, 4323 Riverside Rd. comments:
· The Town of Waterford has a responsibility for the water draining through a 10' easement in the Waterford Woods directly south of his property, because there is a catch basin connected to the culvert under Riverside Rd.
· Mr. Sweet stated that he had previously spoken to Ken Hinz
· He stated that his property shouldn't be used as a watershed by the Town of Waterford
· Mr. Sweet asked the Town to take care of the problem and assume responsibility for the culvert going to the river
· He states that the culvert was installed by the Town of Waterford Sanitary District in 1986
· He asked the Town to install a 12" drain tile and re-build the catch basin

Chairman Langmesser asked Mr. Sweet if he had previously stated that the drain tile had been installed by the Sanitary District. Mr. Sweet stated yes.

Mr. Sweet then stated that his property in a 100 year floodplain. Mr. Sweet further stated that once a "drain" is installed that it becomes the Town's responsibility to maintain. Chairman Langmesser reminded Mr. Sweet that the Town had agreed to pay $500.00 for the pipe and that Mr. Sweet had agreed to have the pipe installed at no cost to the Town. Chairman Langmesser stated that the next time he spoke with Mr. Sweet, the cost had increased to $1100.00 and Mr. Sweet would not have it installed. Mr. Sweet suggested that the Chairman should "grab the horse by the balls".

Supervisor Baumgart asked Mr. Sweet if he had been on the agenda of any Sanitary District meetings. Mr. Sweet stated that he had not. He also could not remember who he talked to at the Sanitary District. Michael Barrett, 4317 Riverside Rd., on the south side of the 10' outlot stated that he has been blamed for Mr. Sweets flooding problem because he had raised his home and yard 3' in elevation. Dennis La Court, 4316 Riverside Rd., asked what is going on with the drainage problem, and what it would cost to fix it. Mr. La Court felt that the drain pipe was installed more than 30 years ago and not by the Sanitary District as Mr. Sweet alleges.

Susan Czarnecki, 30332 Beachview Ln., stated that the water floods over the road in heavy rains because neighbors have filled din their ditches over the years to make mowing easier. Mr. Barrett complained about the pitch of the Riverside Rd. He would like the road re-pitched to drain to the west. He stated that he is in the construction business and commented that there is only a 4-5" drop in the 175' from the road to the river. He stated that they would need to be a 20" drop to get water to flow properly. Donna Block stated that Ken Hinz had told her there was a 14" drop from the edge of Riverside Rd. to the river. She further stated that Ken Hinz had told her that there should be a minimum of 4" of fill over the top of the tile when installed properly.

Mr. Barrett stated that drain tile should not be used above the frost line. He recommended that a plastic pipe that will not be damaged by frost should be used, which is sealed and smooth on the inside. He stated that this type of tile should cost $5.50/foot. Chairman Langmesser made a motion to have the Town DPW do the repairs needed, seconded by Supervisor Baumgart. Discussion followed regarding getting this matter on the agenda for a future Waterford Woods Assn. meeting. Mr. Sweet stated that the Waterford Woods Assn. agreed to contribute $1000.00 toward the project. Supervisor Gauerke state that an easement would need to be drafted by an attorney for the Waterford Woods Assn. and that a survey showing the specifications would have to be prepared. These documents would need to be approved by the Town Attorney. These documents would then have to be recorded in Racine Co. before the work could be done. Vote taken: All in favor. Motion carried. Mr. Barrett stated that Supervisor Kacmarcik had told him that a roof gutter drain that he installed which drains directly into the 10' easement would have to be moved. The board had no comment.

Supervisor Block motioned to adjourn the meeting at 9:35 am, seconded by Supervisor Baumgart. All in favor motion carried.
