SPECIAL TOWN BOARD MEETING FOR WATERFORD
UNAPPROVED/UNOFFICIAL MINUTES FOR JULY 14, 2008
5:15 PM AT TOWN HALL

Special Town Board meeting was called to order at 5:15 PM by Chairman Langmesser. Present: Block, Baumgart and Gauerke.

Sally Jo Nelson, Waterford Graded School, gave information on the process that they have gone through to get where they are regarding the school project. Nelson stated she wanted the Board to understand the process and that they wanted to continue to examine their options. Nelson stated that she was looking for direction from the Town Board to see if they should proceed. Board agreed that the project has come at a bad time and that people are very concerned and will probably not support the project. The Board gave some comments and stated that the public needs more explanation and more awareness.

Block motioned to adjourn the special meeting at 5:50 PM, seconded by Gauerke. Motion carried.

6:00 PM AT TOWN HALL

1. Town Board meeting was called to order at 6:24 PM by Chairman Langmesser. Present: Gauerke, Block, Baumgart, Attorney Dubis and residents of the Town.

2. Chairman Langmesser led the Pledge of Allegiance.

3. Printed Minutes: Gauerke motioned to approve the Town Board meeting minutes dated June 9, 2008 and the special meeting minutes dated June 11, 2008 as corrected, seconded by Baumgart. Motion carried.

4. Treasurer Report/Payment of Claims- Gauerke motioned to approve the claims as presented, seconded by Block. Motion carried.

5. Correspondence: Certificates were handed out to two officers that had saved a young girl from drowning in a pool in the Town of Waterford. Block read letter from WI DOT. Item has been referred to the Town Engineer and Attorney.

6. Committee Reports:
a Police Dept. Report- Chief Ditscheit reported that the CUT program was going very well and that there had been a lot of positives. Ditscheit stated they had a record turnout for boater safety and that there were a lot more adults than normal. Ditscheit reported that the Alcohol Enforcement Grant was running. Ditscheit also reported that Officer Steffens and he were meeting with the Village to work out the details with the first shift in the Village and the ability for Town Police Officers to enforce Village ordinances.
b Waterways Committee- Bob Hardy reported that they were having the pontoon classroom on July 25th. Hardy also asked permission for the WWMD to place sediment traps within certain right of ways in the Town. Board had letter with the information. Langmesser motioned to approve WWMD to place the traps with in Town right of ways, seconded by Block. Motion carried.

c Park- Langmesser reported that they had corrected the vandalism and asked the residents again to keep an eye out for violators.

d Road Dept.- Langmesser reported the road crew was working on paving and shouldering.

e Town Planning Recommendations-
§ Pier Permit & Boat Lift- Cassata, 4337 Riverside Rd.- Gauerke stated that the end of the existing pier was 10'x16' totaling 160 sq. ft. and the ordnances maximum was 112 sq. ft. Applicant, Warren Cassata, stated it was a floating pier and that he would have to tear it down completely and replace. Gauerke suggested the applicants apply for a variance. Langmesser motioned to approve the pier permit and boat lift contingent upon the town does not receive any complaints within the next six months. Bob Hardy, WWMD, stated that he felt the pier wouldn't be an issue with other boats. Baumgart seconded the motion. Motion carried.
§ Pier Permit- Roth, 28613 Burma Ln. - Gauerke motioned to accept Planning's recommendation for approval, seconded by Block. Motion carried.
§ Pier Permit- Perri, 5737 Scenery Dr.- Gauerke motioned to accept Planning's recommendation for approval, seconded by Block. Motion carried.
§ Rezone- Bielinski Homes, Southwest side of Northwest Hwy.- No action, applicant requested to be layed over to August Town Board.
§ CSM- Depree, Hill Valley Rd.- No action
§ Conceptual Rezone & CSM- Rausch, 6831 Big Bend Rd.- Dubis stated applicant would have to re-apply. Langmesser stated that the applicant was concerned about time. Applicant to meet with Dubis to be directed on what to do. No action taken.
§ Rezone/Conditional Use/Extractive Operations Permit- Payne & Dolan, 7651 Northwest Hwy.- Block read letter from Adeline Flintrop. Discussion took place on the depth of the mining. Postotnik stated they would only be mining 15 feet down and not into the water table and that they would be recycling the water they use. Gauerke motioned to approve the rezone, conditional use and extractive operations permit based on:
-The recommendations of the Town of Waterford Planning Commission
-Racing Co. Planning recommendations dated 6-19-08
-The Town Engineers 7/10/08 recommendations
-The Town Engineers review of the restoration, elevation and bottom of pit grades
-No mining within 75 ft of the wetlands
-No removal of top soil from the property
-Restoration of the property to its A-1 zoning after the restoration of property has been completed
-Subject to Payne & Dolan paying all fees and Town Engineering costs incurred with the project
-If problems documented to be caused by the operation arise (i.e. neighbors wells) applicant would be responsible for making the necessary improvements or corrections.
-Applicant responsible for cleanup of any spills associated with petroleum products
-Conditional Use permit to be reviewed every 2 years in conjunction with their extraction permit
Block seconded the motion. Motion Carried.

7. Old Business:
(a) Lt. Mike, Tichigan Volunteer Fire Company, stated the MABAS contract was up for renewal and that nothing other than some statutes had changed. Langmesser motioned to approve subject to Attorney Dubis making sure there are no changes, seconded by Block. Motion carried.

8. New Business:

Gauerke motioned to adjourn the meeting at 6:55 PM, seconded by Baumgart. Motion carried.
