 PLANNING COMMISSION MEETING
415 N. MILWAUKEE ST.
FEBRUARY 4, 2008 at 6:00 PM
UNAPPROVED / UNOFFICIAL MINUTES

1. Planning Commission meeting was called to order at 6:00 PM by Chairman Langmesser. Present: Langmesser, Ranke, Sohr, Gerard, Derse, Szeklinski, Attorney Dubis and Residents. Commissioner Schmidt was excused.

2. Chairman Langmesser led the Pledge of Allegiance.

3. Ranke motioned to approve the January 14, 2008 meeting minutes as written, seconded by Szeklinski. Motion carried.

4. Correspondence- None

5. Rezone- L&T Development, East side of Hwy. 164 South of N. Lake Dr., R-3 & A-3 to Commercial- Item was deferred from January meeting. Chairman Langmesser noted that SEWPC informed the Town that we did not have enough commercial land. This parcel was platted for commercial in the updated 2035 Plan. Commissioner Gerard motioned to recommend approval of the rezone to the Town Board conditional upon the Town's ability to retract approval at the time the Town receives the application from Racine County, seconded by Commissioner Derse. Supervisor Gauerke thought Mr. Langan needed correspondence from the DOT. Attorney Dubis noted that that was for the 3 new CSM which was not on this agenda. Vote taken: 4 in favor, 1 opposed (Szeklinski). Motion carried.

6. Pier Permit- Hansen, 5735 Island View Ct.- Commissioner Gerard excused himself as he is the agent for the Hansens. Commissioner Derse motioned to approve the pier as presented, seconded by Commissioner Sohr. Motion carried.

7. Shore land Contract Report- Commissioner Derse indicated that there were 4 shoreland contracts. Commissioner Derse notified County regarding his many concerns. Chairman Langmesser noted that for the record a motion should be made that Commissioner Derse had these items were evaluated. Commissioner Derse motioned that he had these items evaluated, seconded by Commissioner Szeklinski. Motion carried.

8. Announcements/Discussion- Karen Novak had some questions for Tom Langan and was informed to wait until he was on the agenda. Mr. Langan at this time had left the building.
Commissioner Ranke motioned to adjourn the meeting at 6:20 PM, seconded by Commissioner Sohr. Motion carried.

TOWN BOARD MEETING FOR WATERFORD
UNAPPROVED/UNOFFICIAL MINUTES FOR FEBRUARY 11, 2008
6:00 PM AT TOWN HALL

1. Town Board meeting was called to order at 6:00 PM by Chairman Langmesser. Present: Gauerke, Block, Baumgart, Kacmarcik, Attorney Dubis and residents of the Town.

2. Chairman Langmesser led the Pledge of Allegiance.

3. Printed Minutes: Baumgart motioned to approve the Town Board meeting minutes dated January 14, 2008 as written, seconded by Gauerke. Motion carried.

4. Treasurer Report/Payment of Claims- Block motioned to approve the claims as presented, seconded by Baumgart. Motion carried. Langmesser read the Treasurer's report.

5. Correspondence: Langmesser read a letter from Beth Bechtel thanking the Dept. of Public Works for their wonderful job in snowplowing.

6. Committee Reports:
(a) Police Dept. Report- Chief Ditscheit reported 418 calls and contacts for the month of January. Chief attended a week long conference in Madison. NIMS 200 level has been completed with the 300 level to begin soon.
(b) Waterways Committee- None
(c) Park- Chairman Langmesser asked that if anyone sees anyone vandalizing the park to please call it in. All this continuous damage only hurts the taxpayers.
(d) Road Dept. - Snowplowing; snowplowing and more snowplowing!
(e) Town Planning Recommendations-
§ Rezone- L&T Development, East side of Hwy. 164, South of N. Lake Dr. - Gauerke motioned to accept Planning's recommendation to approval conditional upon the Town's ability to retract approval at the time the Town receives the formal rezone application from Racine County, seconded by Block. Motion carried.
§ Pier Permit- Hansen, 5735 Island View Ct.- Gauerke motioned to accept Planning's recommendation for approval, seconded by Block. Motion carried.

7. Old Business:
(a) Developers' Agreement- Tichigan Mobil- Attorney Dubis noted that he had reviewed the agreement and that both he and Matt Fineour, Crispell- Snyder, Inc. felt it was ready to be signed. Chairman Langmesser questioned who was responsible for maintaining the catch basins. Attorney Dubis noted that would be the responsibility of the gas station. Attorney Dubis also stated that in the event of run-off the gas station would be responsible for all cost incurred during clean-up. It was also reported that the inspections are to be done quarterly. Supervisor Kacmarcik motioned to approve the Developers' Agreement with Tichigan Mobil, seconded by Supervisor Block. Motion carried.
(b) Golden Bay- Regarding Town taking over roads- Chairman Langmesser recused himself from the meeting for this item and therefore leaving Supervisor Block to chair this portion of the meeting. Jon Voss, 28629 Sandpiper Trail, read a statement to the Board. Attorney Dubis indicated that he was working with the Bay Association attorney and their next planned meeting was February 20th. Supervisor Block indicated that this was mostly informational. No formal Board action was taken. Chairman Langmesser resumed his roles as Chairman.

8. New Business:
(a) Ordinance adopting the Wisconsin Uniform Building Code Schedule of Permit Fees- Supervisor Kacmarcik motioned to approve the ordinance as written, seconded by Supervisor Gauerke. Motion carried.
(b) Slow No Wake Request, Mink, 5850 N. River Bay Rd.- Robert Mink indicated that there are a lot of speeders in this area and they are afraid for the young children who play in the water. Supervisor Block motioned to approve the Slow No Wake subject to approval form the Waterford waterways Management District, seconded by Supervisor Kacmarcik. Motion carried.

Supervisor Kacmarcik motioned to adjourn the meeting at 6:45 PM, seconded by Supervisor Block. Motion carried.
