TOWN OF WATERFORD SANITARY DISTRICT NO. 1

APPROVED MINUTES

November 14, 2007

Commissioner Pisarski called the meeting to order at 4:30 p.m.

Present: Commissioners Pisarski, Hinz and Ciesielski
Absent: None
Also Present: Robert Bowker; Chuck Smith; Gerry Kovalik; Lynn Tamblyn, WRCSD; Duane Erickson, Operations Superintendent; and Debbie Crawford, Administrator

Ciesielski motioned to approve the minutes from the October 10, 2007 Public Hearing on the 2008 Budget as printed, seconded by Hinz. All in favor. Motion carried.

Pisarski moved to agenda item Request for Contributing Towards the Paving of Cedar Lane. Bowker, Smith, and Kovalik are three of the seven property owners on Cedar Lane, which is a private road. Due to the development of Foxwater Bay, Cedar Lane has been moved 20' north of where it had been located and is now useable only through this subdivision. The developer has already paid for 60' of Cedar Lane to be paved and the residents are requesting that the WSD contribute towards finishing the paving since our lift station is located on one of these parcels. It was clarified that the WSD does not own the parcel, it is owned by the developer, and the lift station is accessed by easement. Smith stated that three estimates have been received with $10,000 to finish the remainder of the road being in the middle. Ciesielski stated that he spoke with the WSD attorney who said we are not in the road business; we are in the sewer business. Ciesielski also questioned whether this would be a proper use of the WSD funds to pave a road with Pisarski adding this may set a future precedence. Hinz stated the cost was not considerable and should the WSD contribute towards the paving he requested the residents provide in writing that the WSD would not have any attachment to Cedar Lane. Hinz also requested a proposal and breakdown of how much everyone would contribute. Ciesielski motioned to deny paving Cedar Lane at this time and should this item be re-visited it be deferred to the WSD attorney, seconded by Hinz. All in favor. Motion carried.

Pisarski moved to agenda item 28932 Elm Island Drive - Leak in Clean Out/Lateral. Pisarski explained that Ms. Carrigan turned in bills totaling $619.19 from Maas & Sons for work performed to correct a lateral leak at her residence and is requesting reimbursement from the WSD. Erickson said there are several joints that are leaking that need grouting in addition to the work that has already been done. Erickson explained that Carrigan feels the work was done improperly, however there is a signed inspection report stating that it was. Pisarski stated that we do not want to set precedence by reimbursing homeowners for work done to their lateral as by ordinance it is the homeowners responsibility; however in the interest of community he also wants a friendly commission and to make decisions on a case by case basis. Hinz motioned that the work done by Maas be Carrigan's responsibility and being a community spirited organization the WSD will supply our workers, equipment, and will pay for the grouting up to $400, seconded by Ciesielski. All in favor. Motion carried.

Pisarski questioned the commissioners that after having time to review the Sanitary District Rules of Conduct if they had any additions or deletions to the policy with both Ciesielski and Hinz stating they were acceptable as printed. Pisarski questioned whether an addition regarding non-smoking in the building be added with Erickson and Hinz stating it is already state law not to smoke in a municipal building, however they would still suggest adding it in the Rules of Conduct. Pisarski suggested the addition of "This would include but not limit using the facilities and equipment for personal auto maintenance or keeping animals on the districts property with the exception of leader dogs for the blind" under Town of Waterford Sanitary District No. 1 Property. Crawford asked for clarification regarding animals on the property as the sanitary district owns the municipal building and questioned whether the town should be made aware of this policy. Ciesielski stated that years ago a letter was given to the town after our insurance agent saw an animal in the town office and further explained the possibilities of lawsuits that could arise. Erickson and Tamblyn interjected that this is a personnel policy for employees of the sanitary district, not a policy for the building and therefore would not involve the town with Pisarski adding that this should be covered in the lease between the sanitary district and town. Hinz motioned to accept the Sanitary District Rules of Conduct with these amendments, seconded by Ciesielski. All in favor. Motion carried.

Pisarski questioned that now that the Rules of Conduct is policy should this be given to each employee to be signed and acknowledged that they received it with Hinz and Ciesielski agreeing this should be done. Hinz motioned that the new policy be personally be given to each employee and signed that they received it and read it, seconded by Ciesielski. All in favor. Motion carried.

Pisarski moved to agenda item Teamster Union - Employee Representation. Pisarski stated that at this meeting there would not be any action taken and hopefully in the future will not have to experience it either, however Pisarski wanted to note that Norm, Kelly, and Debbie have signed on with the Teamsters as the commission should already be aware of from previously received documentation. Pisarski explained that on the advice of Attorney Geary he has already retained Attorney Halsey to represent the WSD. Pisarski reminded the commissioners that there is a meeting scheduled with labor attorney William Halsey on June 28th. Pisarski mentioned that Crawford had brought to his attention a deadline on the 22nd which would not be met if the commission waited until the 28th for their meeting and that he will confer with Attorney Halsey on that matter. Hinz motioned to retain Attorney Halsey for the purpose of dotting the 'i's' and crossing the't's', seconded by Ciesielski. All in favor. Motion carried.

Pisarski moved to agenda item Re-issue Letter to Town of Waterford for annexation into the District of seven parcels on Highway 164 that is presently served by WSD. Pisarski stated that this letter will include the seventh parcel which is vacant and be re-submitted to the town. Ciesielski motioned to re-submit the letter to the town, seconded by Hinz. All in favor. Motion carried. Pisarski signed the letter.

Pisarski moved to agenda item Review Connection Fee Rates. Discussion ensued. Hinz motioned not to raise the connection fees at this time, seconded by Ciesielski. All in favor. Motion carried.

Under O&M Pisarski asked Erickson if all safety issues had been addressed to bring the WSD into compliance. Erickson stated he has addressed all but a few items with nothing major remaining. Erickson said they may have to get an eye wash for in the shop. Pisarski asked that the safety issues be reviewed at the February meeting. Erickson did not have anything else to report.

Tamblyn reported that the WRCSD will be increasing their rates 4% in their 2008 budget.

Hinz motioned to adjourn at 5:18 p.m. seconded by Ciesielski. All in favor. Motion carried.

UNAPPROVED MINUTES


Having been duly noticed, the meeting was called to order at 4:30 p.m. by Commissioner Pisarski.

Present were Commissioners Pisarski, Hinz, Ciesielski, and Attorney Halsey.

Ciesielski motioned to adjourn to closed session pursuant to Chapter 19.85(1)(c) for the purpose of conferring with legal counsel concerning the District's legal obligations and bargaining posture with respect to the Teamsters' efforts to organize certain District employees, seconded by Hinz. All in favor. Motion carried. Meeting adjourned to closed session at 4:38 p.m.

Ciesielski motioned to return to open session at 5:57 p.m., seconded by Hinz. All in favor. Motion carried.
