TOWN OF WATERFORD SANITARY DISTRICT NO. 1

UNOFFICIAL / UNAPPROVED MINUTES

June 14, 2006

Commissioner Pisarski called the meeting to order at 4:30 p.m.

Present: Commissioners Pisarski, Hinz, and Ciesielski
Absent: None
Also Present: Attorney Christopher Geary; Lynn Tamblyn, WRCSD; Duane Erickson, Operations Superintendent; and Debbie Crawford, Administrator

Hinz motioned to approve the minutes from the May 10, 2006 meeting as printed, seconded by Ciesielski. All in favor. Motion carried.

Tamblyn did not have anything to report on WRCSD.

Pisarski commented that the sanitary district tour was very much appreciated and enjoyed by all that attended. Erickson did a wonderful job in conducting the tour of the sanitary district and a special thanks to Jeff Bratz of WRCSD for the thorough tour of the treatment plant.

Ciesielski motioned to adopt Ordinance #06-01 an Ordinance to Adopt a Code of Ordinances for the Town of Waterford Sanitary District No. 1, seconded by Hinz. All in favor. Motion Carried.

Erickson explained the Compliance Maintenance Annual Report of which the Commissioners had a copy. Ciesielski motioned to adopt Resolution 0606 Accepting the 2006 Compliance Maintenance Annual Report (CMAR) with the Wisconsin Department of Natural Resources NR 208, seconded by Hinz. All in favor. Motion carried.

Discussion ensued regarding the Commissioners access to keys for the municipal building. It was determined that one key to the meeting room is sufficient. Ciesielski motioned to accept as official policy that each Commissioner has the ability to sign out for the meeting room key with Crawford if they so wish, seconded by Hinz. All in favor. Motion carried.

After reviewing Ciesielski's telephone expenses placed on the sanitary district telephone card, it was decided that the telephone card would be returned and any telephone expenses will be turned in on a phone bill highlighting the calls made for sanitary district business. Hinz motioned that all telephone expenses and any other expenses that a Commissioner incurs in performing their duties be submitted monthly to Crawford for payment, seconded by Pisarski. Hinz and Pisarski in favor. Ciesielski opposed. Motion carried. Ciesielski turned in his telephone calling card.

Ciesielski requested in writing that the next item be placed on the agenda. In his request he states that statements made in the April 12, 2006 and May 10, 2006 sanitary district minutes allege that all three sanitary district officers have been operating illegally. After a full and thorough review of the April and May 2006 official sanitary district minutes, the word "illegal" was not used, and there were not any statements, implications, or allegations made of anything that was done illegally. Pisarski had expressed his concern in the April 12, 2006 minutes that it would appear that the Commission is running improperly and not abiding by the term limit that was previously set by the Commission, however, Attorney Geary referred back to the mechanics of what happened beginning with the April 22, 1998 minutes where former Commissioner Koukol moved to limit the term of President to no more than two years and continuing through the minutes pertaining to elections up to and including April 12, 2006. Attorney Geary concluded that the original motion was ambiguous and changed several times over the years; however there was nothing illegal done.

Erickson reported under O&M that the roof has been completely installed on the sanitary district garage. He said they have been working on raising the manholes before the town has the roads paved.

Hinz motioned to adjourn at 5:02 p.m., seconded by Ciesielski. All in favor. Motion carried.
