PLANNING COMMISSION MEETING

UNAPPROVED/UNOFFICIAL MINUTES
1. Planning Commission meeting was called to order at 6:00 PM by Chairman Langmesser. Present: Langmesser, Ciesielski, Schmidt, Ranke, Gerard, Derse, Sohr, and Residents.
2. Chairman Langmesser led the Pledge of Allegiance.
3. Ranke motioned to approve the January 2, 2006 minutes as written, seconded by Ciesielski. Motion carried.
4. Correspondence- None
5. Pier Permit- Weiss, Lot 5, Island View Ct..- Derse asked the applicant if the 30 ft. length was needed. Weiss stated that the length was needed to reach 3ft. of water. Gerard asked if she thought her pier would stick out beyond other piers in the area. Applicant stated that there was only one about 100 ft away and that she thought it was about 25 ft. long. Ciesielski stated that if the applicant were to put in an 8 ft. lift on the West side of the pier she would not meet the 10 ft. setback. The applicant stated she did not take that into consideration. Ciesielski motioned to approve the pier as long as it was moved over to conform with the side yard setbacks once the lift is added, seconded by Sohr. Ciesielski asked what direction the L was facing. Applicant stated it was to face the East. Motion carried. Applicant to submit new drawing for the Town Board.
6. CSM- Delimat, 8427 Big Bend Rd.- Applicant stated that he wanted to sell 5 acres with 150 ft. of road frontage to his son. Ciesielski asked about a drainage study. Applicant stated that the area was all sand and gravel. Langmesser announced that the CSM fell with in the County ordinance of farm preservation land division. Sohr motioned to approve, seconded by Derse. Motion carried.
7. Proposed Subdivision- Marcinkowski/Lauria, 28713 Beach Dr. (JS Development, Agent)- Langmesser asked about the December 27th informational meeting that was held. Agent stated that 20-30 neighbors had attended and their concerns were addressed. Agent also stated that the plan was reduced to 14 lots with a minimum of 40,000 sq. ft. per lot and that the Town Engineer had agreed to the conceptual drainage plan. Ciesielski asked about Canal Ln. Agent stated that Canal Ln. would still remain an easement and that there would be no access onto it. Mary Zastrow, 6604 Canal, asked if the new lots were granted easement, if they would maintain Canal. Agent stated that none of the lots will be accessing Canal, but they plan to re-ditch Canal like it was before the sewer line went through. Commission expressed concern about one way in and one way out of the development. Dale Gauerke, Town Supervisor, on behalf of Leroy Zierath, asked about the primary environmental corridor and the density requirements. Agent stated that not all the trees were going to be cut down, but only the ones within the building pad. Gerard asked about the possibility of getting through Washington Rd. for emergency purposes only. Duane Luick, 28904 Beach, stated that everyone thought Canal Ln. was an easement, but Zierath found out that it is actually a 20 ft. platted road, but currently it is less than 20 ft. wide. Luick asked if the remainder of the 20 ft. was included in the square footage of the new lots. Agent stated that they would have to do a full survey. Langmesser suggested paving Canal and make a town road. Agent stated it would be too difficult due to the environmental corridor. Gary Soiney, 28724 E. River Bay Dr., asked if the Town still adopted the County ordinances and asked when they implemented one way in and one way out. Soiney stated that he felt the cul de sac shouldnt be a problem and that the Commission was giving the applicant a hard time because of it. Mark Marcinkowski, 28705 Beach, stated that there was also Primary Environmental Corridor on the East side and that he didnt see why there was a problem with the cul de sac when there were newer developments such as Fowlers Bay and Stonegate Estates that have cul de sacs. Discussion took place on an emergency access. Langmesser asked what the Commissions opinions were. Schmidt stated he was not in favor of the plan due to not knowing exactly what was in the primary environmental corridor and the concerns of the one way in and out. Mark Marcinkowski stated that the proposed road is 60 ft. wide and should be able to accommodate emergency vehicles turning around. Gerard stated that the one access point was a concern for him, but would be ok with the plan contingent upon the stipulations pertaining to the environmental corridor. Derse stated he had no additional concerns. Ciesielski stated he was concerned for public safety and he wouldnt approve the plan with only one access point. Ranke stated he had the same concerns as Schmidt. Sohr stated that drainage would be an issue for her. Linda Keckhaver, 28806 Irma Ln., stated she had concerns with the speed on Beach, having more traffic and the need for a 4-way stop on Irma and Beach.
8. Shore land Contract Report- No report.
9. Announcements/Discussion-
Ciesielski motioned to adjourn the meeting at 6:59 PM, seconded by Sohr. Motion carried.
