PLANNING COMMISSION MEETING

415 N. MILWAUKEE ST.

DECEMBER 4, 2006 at 6:00 PM

UNAPPROVED/UNOFFICIAL MINUTES

1. Planning Commission meeting was called to order at 6:00 PM by Chairman Langmesser. Present: Langmesser, Ciesielski, Schmidt, Gerard, Derse, Sohr, Ranke, Attorney Michael Dubis and Residents.

2. Chairman Langmesser led the Pledge of Allegiance.

3. Ciesielski motioned to approve the November 6, 2006 regular meeting as written, seconded by Schmidt. Motion carried.

4. Correspondence- None

5. CSM- Rouse, 32742 Sunburst Ct.- Rouse did note that she checked with a title company and in fact this parcel had always been one lot not once two as she previously had thought. Rouse also indicated that there are four (4) smaller lots in this subdivision than her proposed 1.5 and 2.63 acres. Larry Gabrysiak, 32747 Sunburst Ct., expressed concern that the proposed division would create lots too small for the area and would set precedence. Dubis indicated that Rouse is within the guidelines. Gerard motioned to recommend approval as this part/area of Sunburst Heights does not conflict with the surrounding area, seconded by Derse. Motion carried.

6. CSM-Gorsline, 28541 Beach Dr.- Schmidt motioned to recommend approval, seconded by Derse. Motion carried.

7. CSM- Senft, 28997 Cherry Ln.- Gerard noted that Senft had not obtained the information that was previously requested of him at last months planning commission meeting. Langmesser noted that approval of the CSM does not constitute buildability, however, Dubis also noted that the road issue is critical. Discussion followed as to what county would require. Gerard motioned to recommend that the cul-de-sac be constructed prior to the CSM being approved, seconded by Derse. Motion carried.

8. CSM- Reinholtz, 34210 Janesville Dr.- Dubis requested that proof be submitted that these lots are deeded to family. Margaret Reinholtz voluntarily deed restricted the new lots to no further land division without prior Town Board approval. Sohr motioned to approve, seconded by Gerard. Motion carried.

9. James & Amber Kujawa, 7622 N. Tichigan Rd.- Gary Foat, Kujawa surveyor, reported that he needs to know the road width in order to complete the CSM. He noted that this is not recorded. Dubis stated that this CSM may not meet Town requirement and that Kujawa understand that he could spend a lot of time and money and not get approval. Langmesser suggested that Dubis meet with Gary Foat. Derse motioned to postpone until January Planning Commission, seconded by Gerard. Motion carried.

10. Extractive Operations Permit- Ranke motioned to approve the permits for Payne & Dolan (Honey Creek and Prager) & Parkview Sand & Gravel, seconded by Schmidt. Motion carried.

11. Shore land Contract Report- Gerard noted that there were no shoreland contracts.

12. Announcements/Discussion-

Ciesielski motioned to adjourn the meeting at 6:55 PM, seconded by Derse. Motion carried.

TOWN BOARD MEETING FOR WATERFORD

UNAPPROVED/UNOFFICIAL MINUTES FOR DECEMBER 11, 2006

6:00 PM AT TOWN HALL

1. Town Board meeting was called to order at 6:00 PM by Chairman Langmesser. Present: Gauerke, Block, Baumgart, Kacmarcik, Attorney Dubis and residents of the Town.

2. Chairman Langmesser led the Pledge of Allegiance.

3. Printed Minutes: Kacmarcik motioned to approve the Town Board meeting minutes dated November 13, 2006 and the special minutes dated October 21st, 28th, 31st and November 13, 2006 as written, seconded by Baumgart. Motion carried.

4. Treasurer Report/Payment of Claims- Block motioned to approve the claims as presented, seconded by Gauerke. Motion carried. Langmesser read the Treasurer’s report.

5. Correspondence: None.

6. Committee Reports:

(a) Police Dept. Report- Chief Littmann reported 620 calls and contacts for the month of November.

(b) Waterways Committee- None

(c) Park- None

(d) Road Dept. – Langmesser reported that the Town received several comments about how well the plows did during this past snow storm.

(e) Town Planning Recommendations-

§ CSM- Rouse, 32742 Sunburst Ct.- Gauerke noted that back in May, 1978 a CSM was requested and denied for this property. He also noted that the smaller lots to the west are not part of the Sunburst Heights subdivision. Gauerke motioned to deny the CSM, seconded by Baumgart. Vote taken: 2 in favor, 3 opposed (Block, Kacmarcik and Langmesser). Langmesser motioned to rehear this request subject to a perk test (that Racine County wanted), seconded by Block. Vote taken: 4 in favor, 1 opposed (Kacmarcik). Motion carried.

§ CSM- Gorsline- 28541 Beach Dr.- Gauerke motioned to accept Planning’s recommendation for approval, seconded by Baumgart. Motion carried.

§ CSM- Senft- 28997 Cherry Ln.- Gauerke motioned to accept that the Town of Waterford wants the cul-de-sac and the CSM to be discussed at a later date, seconded by Baumgart. Motion carried.

§ CSM-Reinholtz, 34210 Janesville Dr.- Gauerke motioned to accept Planning’s recommendation for approval, seconded by Block. Dubis reiterated that the Reinholtz is to make sure that she gets the clerk copies of the deeds showing that the lots were sold to family. Motion carried.

§ James & amber Kujawa, 7622 N. Tichigan Rd. – No action

§ Extractive Operations Permits- Payne & Dolan and Parkview Sand & Gravel- Gauerke motioned to accept Planning’s recommendation for approval, seconded by Kacmarcik. Motion carried.

7. Old Business:

(a) Resolution for Multi-Jurisdictional comprehensive plan- Kacmarcik motioned to approve, seconded by Gauerke. Motion carried.

(b) Fox Water Bay- Letter from law office of Cramer, Mlthauf and /Hammes- No representatives were in attendance. Attorney Dubis is to review.

(c) Golden Bay- Regardint ake over of roads- Langmesser recused himself as he is a resident of this subdivision. Ron Merritt, 28729 Clove Ct., Jon Voss 28629 Sandpiper Trail, and Norman Ross 7902 Lakeview Rd. represented the homeowners association. Supervisor Block chaired this portion of the meeting. Voss indicated that the Town engineer, George King, suggested 15’ row, on both sides, for snow and 5’ for road work. Blcok questioned how this would affect lawns in terms of possible damage done by the plows. Merritt indicated that this would be the homeowners’ responsibility. Voss also noted that the school children are picked uip on N. Lake Dr. because the bus company said that they are not insured for a private road. However, if the town were to take over the roads the bus co. would be able to into the subdivision. Dubis noted that if all the residents of this subdivision are giving these easements there is a lot of work yet to be done. Gauerke read comments from George King’s letter dated 10/26/06. Kacmarcik motioned to approve taking over the roads for discussion purposes only, seconded by Baumgart. Gauerke indicated that he was opposed. Block noted the following concerns that she had: 1. believes it would be setting a precendence as the Town has a lot of private roads; 2. budgetary reasons, no money in this years budget and 3. storm water drainage. Langmesser, as a resident, responded that as far as the other private roads go some aren’t even wide enough to take over. Gauerke indicated that there would be great expense should there be damage and/or replacement needed for the concrete curbs. Kacmarcik motioned to take over the roads subject to engineering, legal approval, subject to the association escrowing money for the engineering and legal fees and secondary Town Board approval, seconded by Baumgart. Vote taken: 3 in favor, 1 opposed (Gauerke). Motion carried.

8. New Business:

(a) Town Level Variance- Carignan/Werra, 28932 Elm Island Dr.- Mobile home size- Langmesser motioned to approve the variance, seconded by Baumgart. Motion carried.

(b) Bartender License(s)- None

Gauerke motioned to adjourn the meeting at 7:05 PM, seconded by Block. Motion carried.
