PLANNING COMMISSION MEETING

415 N. MILWAUKEE ST.

AUGUST 7, 2006 at 6:00 PM

APPROVED/OFFICIAL MINUTES

1. Planning Commission meeting was called to order at 6:00 PM by Chairman Langmesser. Present: Langmesser, Ranke, Gerard, Derse, Sohr, Schmidt and Residents. Ciesielski was excused.

2. Chairman Langmesser led the Pledge of Allegiance.

3. Schmidt motioned to approve the July 3, 2006 minutes as written, seconded by Derse. Motion carried.

4. Correspondence- None

5. Preliminary Plat- Marcinkowski/Lauria- “The Woods of Still Water”- James Schilling indicated that this plat does not differ greatly from the concept plan that was previously presented to the planning commission. Langmesser questioned whether or not impact fees would apply. Dubis indicated yes because this was submitted prior to the change in law. Derse motioned to approve subject to applicant adhering to the July 7th drawing of the plat; Crispell-Snyder, Inc.’s comments in their July 13th letter and subject to the County comments in their letter dated July 19th, seconded by Schmidt. Motion carried.

6. Variance- O’Donnell, 29109 Beechwood Ln. - Clerk read comments from Krystal Friemark into record. Gerard motioned to defer to September planning commission, seconded by Sohr. Motion carried.

7. Town Level Variance- Alby Materials, 32409 High Dr. – Michael Bartholomew indicated that this was for the retail business only not for crushing or mining. Gerard motioned to approve subject to Alby bringing in the stated hours to the Town Board and that it state that this is non-mining and non-crushing, seconded by Sohr. Motion carried.

8. CSM- Coates, 7302 N. Tichigan Rd. - Gerard motioned to approve, seconded by Derse. Motion carried.

9. CSM- Bucholtz, 5818 Big Bend Rd. - Ranke motioned to approve, seconded by Derse. Motion carried.

10. CSM- Skalla, 4860 N. River Bay Rd. - Sohr motioned to defer to Town Board, seconded by Gerard. Motion carried.

11. Conditional Use- Dzik, 28747 N. Lake Dr. - Gerard excused himself from this matter. Derse motioned to approve the CUP with Racine Co. comments in the July 24, 2006 dated letter with the exception of the following numbers, 4d; 8; 11; 21 (1st one listed in letter), seconded by Sohr. Motion carried.

12. Lou’s Lakeside Pub, 28837 Beach Dr. - Several residents were in appearance, some in favor and some opposed. Clerk read into record the comments from Krystal Friemark. Some of the complaints were regarding noise and the narrow canal. Some in favor stated that the canal is a no wake and the Town should look into the jet skiers going too fast. Gerard motioned to defer to Town Board, seconded by Sohr. Motion carried.

13. Conceptual Development- Richter, Hwy. 164- Melissa Oberst, applicant. Commissioners were not in favor of this type of development as presented.

14. Shore land Contract Report- Derse indicated that there were three.

15. Announcements/Discussion- September planning commission meeting will be held on the 5th.

Schmidt motioned to adjourn the meeting at 7:20 PM, seconded by Sohr. Motion carried.

TOWN BOARD MEETING FOR WATERFORD

APPROVED/OFFICIAL MINUTES FOR AUGUST 14, 2006

6:00 PM AT TOWN HALL

1. Town Board meeting was called to order at 6:00 PM by Chairman Langmesser. Present: Gauerke, Baumgart, Kacmarcik, Attorney Dubis and residents of the Town. Supervisor Block was excused.

2. Chairman Langmesser led the Pledge of Allegiance.

3. Printed Minutes: Gauerke motioned to approve the Town Board meeting minutes dated July 10, 2006 and the special minutes dated July 10, 2006 as written, seconded by Baumgart. Motion carried.

4. Treasurer Report/Payment of Claims- Gauerke motioned to approve the claims as presented, seconded by Baumgart. Motion carried. Langmesser read the Treasurers’ report.

5. Correspondence: Langmesser read a thank you note from the Tichigan Lake Fireworks Committee. He also read letters from Bob Hardy, WWMD, regarding a $1000 reward for information leading to the arrest and conviction of parties destroying the buoys as well as a letter wanting the Town to pick up the seaweed from riparian residents. Langmesser requested that Supervisor Kacmarcik investigate this matter.

6. Committee Reports:

a Police Dept. Report- Off. Johnson reported 618 calls and contacts for July. Kacmarcik noted that effective September 1st, Off. Johnson will be the new sergeant.

b Waterways Committee- Derse reported that the annual meeting is August 19th at 10:00 am at the WUHS.

c Park- Langmesser discussed briefly the effect of the new impact laws on the Town.

d Road Dept. – Langmesser reported that they have started crack-filling and shouldering.

e Town Planning Recommendations-

§ Preliminary Plat- Marcinkowski/Lauria-“The Woods of Still Water”- Concerns were raised about Canal Lane being listed o the plat as an outlot. Dubis to investigate. Kacmarcik motioned to approve contingent on the Canal Lane issue being reviewed and that the Town reserves the right to change the configuration of the plat should this matter alter the plat; setbacks being placed on the pre-plat and that the impact fees do apply as this was submitted prior to the new law change, seconded by Gauerke. Motion carried.

§ Variance- O’Donnell, 29109 Beechwood Ln. - Board took no action.

§ Town Level Variance – Alby Materials, 32409 High Drive- Langmesser motioned to approve subject to the hours listed on the memo received from Alby's on 8-10-06, seconded by Gauerke. Motion carried.

§ CSM- Coates, 7302 N. Tichigan Rd. - Coates indicated that he had no problem paying the impact fee. Gauerke motioned to approve, seconded by Kacmarcik. Motion carried.

§ CSM- Bucholtz, 5818 Big Bend Rd. - Gauerke motioned to approve, seconded by Kacmarcik. Motion carried.

§ CSM- Skalla, 4534 N. River Bay Rd. – Langmesser motioned to approve, seconded by Gauerke. Motion carried.

§ Conditional Use- Dzik, 28747 N. Lake Dr. - Gauerke motioned to accept the planning commission recommendation as stated in their motion, seconded by Kacmarcik. Motion carried.

§ Lou’s Lakeside Pub- Baumgart motioned to defer to County for a CUP and the Town will hear the application in the future, seconded by Gauerke. Motion carried.

§ Conceptual Development- Richter, Hwy. 164- Gauerke indicated that this was informational only.

7. Old Business:

(a) None

8. New Business:

(a) Compliance Assurance Plan- clerk indicated that this is something every municipality must complete. Dubis to review.

(b) Discussion pertaining to impact fees- Langmesser motioned to allow the 5 impact departments to spend their money collected up until the change in the law with it being spent the same way as it was before, seconded by Gauerke. Motion carried.

(c) Bartender License(s) - Kacmarcik motioned to approve the bartender’s licenses for Tanya Bailey, Donald Goedde, Nancy Bazen, Andrea Pierret, Leslie Eckhardt, Stacy Schmidt and Christine Powers, seconded by Langmesser. Motion carried.

(d) Discussion pertaining to pier ordinance- Baumgart indicated that the DNR informed him that a provision of our pier ordinance was too liberal. This was regarding the amount of watercraft that can be moored. Dubis to review.

(e) Trick-or-Treating- Langmesser motioned that the hours would be 4-6:30pm on October 31st, seconded by Gauerke. Motion carried.


Forthcoming events- Kacmarcik indicated that the public hearing for both the fire number signs and the seaweed pick up will be September 18th at 6:00 pm at the Town Hall.

Gauerke reviewed the consolidation plan for the Town and Village of Rochester. Dubis to review and Gauerke will be the contact person.

Gauerke motioned to adjourn the meeting at 7:25 PM, seconded by Kacmarcik. Motion carried.
