PLANNING COMMISSION MEETING

APRIL 3, 2006 at 6:00 PM
UNAPPROVED / UNOFFICIAL MINUTES
1. Planning Commission meeting was called to order at 6:00 PM by Chairman Langmesser. Present: Langmesser, Ciesielski, Ranke, Gerard, Derse, Sohr, and Residents. Schmidt was excused.
2. Chairman Langmesser led the Pledge of Allegiance.
3. Ciesielski motioned to approve the March 6, 2006 minutes as written, seconded by Sohr. Motion carried.
4. Correspondence- Chairman Langmesser gave a synopsis of the special meeting that was held at 5:00 pm.
5. Preliminary Plat- Foxwater Bay & CSM, L&T Development- Located behind Grebes One Stop- To, Langen spoke briefly on the drainage concerns. He noted that the CSMs will be 6 lots and each lot will pay to maintain the 36 acres of woods. There will also be a conservation easement. Wally Ott, Racine-Kenosha Land Trust, indicated that there was still some work to be done regarding this easement. George King indicated that he had not seen the newest Pre-Plat that was presented this evening. Dubis noted that the planning commission should take action as the town board will need to act next week. King questioned if the commission would have a problem with a home on private road, Dubis reported that the town has allowed this before in the past. King also noted that he would like to see Foxwater Terrace relocated on the map as there may be confusion when people are turning. King further noted that the landscaping in the easement should be maintained by the developer. Sohr motioned to recommend approval of the CSMs subject to Town engineer and Town attorney approval and to the town board reviewing the conservancy issues, seconded by Derse. Motion carried. Pre-Plat- Langen requested that this item be postponed to the May planning commission meeting. Derse motioned to accept this request, seconded by Ciesielski. Motion carried.
6. CSM- Frank, 5549 Buena Park Rd.- Clerk indicated that county will require the Franks to rezone to R-2. Ciesielski motioned to recommend approval, seconded by Sohr. Motion carried.
7. CSM- Acker, 30812 Kramer Dr.- Ranke motioned to recommend approval, seconded by Ciesielski. Motion carried.
8. Pier Permit- Danowski, 28935 Elm Island Dr.- Ciesielski motioned recommend approval, seconded by Sohr. Motion carried.
9. Pier Permit- Immel, 6731 Irma Ln.- Gerard motioned recommend approval, seconded by Ciesielski. Motion carried.
10. Pier Permit- Paulkner, 5405 E. Peninsula Rd.- Ciesielski motioned recommend approval, seconded by Ranke. Motion carried.
11. Pier Permit- Hidden Harbor, located between 7142 Joy Marie & 7132 Peterson Ct.- Gary Bluemel indicated that they were not requesting boat slips. Ciesielski motioned to defer to Town Board to allow review of court orders, seconded by Gerard. Motion carried.
12. Rezone- Slack/Franecki, 29748 Raab Dr.- Sohr motioned to defer to May planning commission, seconded by Ciesielski. Motion carried.
13. Conceptual Rezone & CSM- Kujawa, 7622 N. Tichigan Rd.- B-6 to A-3 & R3-A- Ciesielski motioned to recommend approval subject to the Kujawas relinquishing their Class B liquor license, seconded by Derse. Motion carried.
14. Special Event Camping- Hoppe, 33701 Hill Valley Rd.- Dubis noted that he did not think that the Hoppes could comply with the Town ordinance. Sohr motioned to recommend denial of the request as it does not comply with the Town ordinance, seconded by Gerard. Motion carried.
15. Shoreland Contract- Barrett, 4317 Riverside Rd.- Jeff Kruger, Turn-Key Homes, reported that they will need approximately 3 cubic yards to raise the home out of the flood plain. Sohr motioned recommend approval, seconded by Ranke. Motion carried.
16. Shoreland Contract Report- Derse gave report.

TOWN BOARD MEETING FOR WATERFORD
UNAPPROVED / UNOFFICIAL MINUTES FOR APRIL 10, 2006
6:00 PM AT TOWN HALL
1. Town Board meeting was called to order at 6:00 PM by Chairman Langmesser. Present: Gauerke, Block, Baumgart, Kacmarcik, Attorney Dubis and residents of the Town.
2. Chairman Langmesser led the Pledge of Allegiance.
3. Printed Minutes: Block motioned to approve the minutes dated March 13, 2006 as written, seconded by Gauerke. Motion carried.
4. Treasurer Report/Payment of Claims- Kacmarcik motioned to approve the claims as presented, seconded by Block. Motion carried. Langmesser read the treasurers report.
5. Correspondence:
* Langmesser motioned to reduce the letter of credit for Fowlers Bay Subdivision, seconded by Baumgart. Motion carried.
* Langmesser read a letter from Paul Klepp, 4418 Golf Ln., regarding the drainage problem on his property. DPW to go investigate his situation.
* Clerk informed the board that Jim Daniels, Gale Cr., was out of town and would like to be heard next month. Langmesser noted that it is being reviewed.6. Committee Reports:
a Police Dept. Report- Chief Littmann reported 573 calls and contacts for the month of March. Littmann also reported that he received a DNR reimbursement in the amount of $21,290.73.
b Waterways Committee- None
c Park- Langmesser reported that the town will be making a regulation ball diamond.
d Road Dept. Langmesser reported that the town is bidding out road projects.
e Town Planning Recommendations-
§ Preliminary Plat & CSM- Foxwater Bay- Plat was postponed to the May Planning Commission. Gauerke motioned to approve the CSMs subject to approval by the Town Board and the Town Attorney of the conservation easement; drainage study approved by the Town Engineer and the Town Board and restrictions on the 35 acre parcel, seconded by Langmesser. Motion carried.
§ CSM- Frank, 5549 Buena Park Rd.- Langmesser motioned to approve, seconded by Block. Gauerke abstained. Motion carried.
§ CSM- Acker, 30812 Kramer Dr.- Gauerke motioned to approve, seconded by Block. Motion carried.
§ Pier Permit- Danowski, 28935 Elm Island Dr.- Gauerke motioned to approve, seconded by Kacmarcik. Motion carried.

§ Pier Permit- Hidden Harbor, Langmesser motioned to approve the pier due to the 1997 court decision of the Circuit Court in Hidden Harbor v. Racine County which allowed for the placement of a temporary pier, with annual removal and installation, with no boat slips; no docking overnight and no launching of boats except carry in types such as canoes, seconded by Gauerke. Motion carried.
§ Rezone- Slack/Franecki, 29748 Raab Dr.- Planning postponed to May. No Board action required.
§ Conceptual Rezone & CSM- Kujawa, 7622 N. Tichigan Rd.- Gauerke motioned to approve, seconded by Baumgart. Motion carried.
§ Special Event Camping Request- Hoppe, 33701 Hill Valley Rd.- Gauerke motioned to accept the planning commission denial, seconded by Block (for discussion purposes only) Dubis indicated that Hoppe will need a variance. Tim Hoppe submitted a petition he noted was signed by 74 residents in that area, Block did indicated that she was concerned about the # of campsites. Larry Gabrysiak, Sunburst Ct. reviewed the past problems with this property. He also noted that 195 campsites with 6/site would result in 1170 people. He felt this was too much. Dubis did state that he felt the Hoppes would not be required to go before the planning commission. Gauerke rescinded his motion and Block rescinded her second. Gauerke motioned to accept the planning commissions recommendation for denial, seconded by Baumgart. Motion carried.
§ Shoreland Contract- Barrett, 4317 Riverside Rd.- Gauerke motioned to approve, seconded by Kacmarcik. Motion carried.

(a) Revised Municipal deposit schedule- Block motioned to approve, seconded by Kacmarcik. Motion carried.
(b) Intergovernmental Cooperative Agreement to facilitate purchase of accessible voting system- Block motioned to approve (no choice- mandated), seconded by Gauerke. Motion carried.
(c) Resolution as to numbering of previously adopted ordinances- Baumgart motioned to approve, seconded by Gauerke. Motion carried.
(d) Ordinance relating to underage drinking- Baumgart motioned to approve, seconded by Gauerke. Motion carried.
(e) Proclamation and Commendation- Langmesser motioned to approve, seconded by Gauerke. Motion carried.
(f) Bartender License(s)- Kacmarcik motioned to approve the following bartender licenses subject to a police background check, seconded by Block. Motion carried.
